BY JAMES ROBINSON FOR MAILONLINE

Britons say their holiday plans are in question due to ‘nightmare’ delays in receiving their new passports.

Families say they fear missing out on long-awaited trips because they haven’t yet received the important travel documents – despite applying months ago.

A family have revealed they have yet to receive a passport almost two months after ordering one – even after paying an extra £120 to ‘speed up’ their application.

Meanwhile, a wedding photographer said she was at risk of losing a £3,000 job in France because her passport hadn’t arrived – despite applying for one in September.

A family have told MailOnline how they risk losing £1,200 on holiday in Spain next month because they still do not have one of their passports.

Ellie Freeman, from Nottinghamshire, said her family (pictured) were still waiting for passports to travel to the Spanish coastal town of Tossa Del Mar next month.

Ellie Freeman, from Nottinghamshire, said her family were still waiting for passports to travel to the Spanish coastal town of Tossa Del Mar next month.

She and her partner Jordan ordered passports for themselves and their two children, one aged four and the other 9 months, in early March.

At the time, the Passport Office recommended a wait time of three to five weeks, meaning the couple had given themselves plenty of time.

They have since received three out of four passports, but are still waiting for their youngest child’s travel document.

Desperate to go on vacation, the couple say they shelled out an extra £100 to expedite the passport application in the hope of receiving it within a week.

But with days running out before their flight, they still haven’t received the travel document.

Hotel worker Ellie, 26, who also missed a trip to Corfu in May last year due to Covid restrictions, said: “It’s been an absolute nightmare.

And it is hope that makes the situation worse. I would rather they just say it won’t be here, because we have to make plans.

“I’ve seen people get there 48 hours before – which is good if it’s a weekend abroad, but it’s difficult if you have kids because there’s a lot of planning to do. “

Ellie’s partner Jordan, 27, who works in customer services, said the couple risked losing all their money due to passport delays – as they are not covered by travel insurance .

“We were left in limbo,” he said. “We did without a lot of extras to save just to go on a family vacation

‘If they had told us a few weeks ago we might have been able to make changes to our booking but so close to the travel date it is non-refundable. So we’re going to lose that £1,200 if we can’t go.

A photographer also told MailOnline how she risked losing £3,000 in sales due to the issue.

Kerri Cuthbert, who runs a photography business, Rockford Studio in Devon, said she ordered a new passport in September after her previous passport expired.

But she says she has yet to receive the travel document – forcing her to cancel a wedding job in Bordeaux in June.

She said: “It’s now almost May and I have to travel in June, and I’ve now had to let the bride and groom know at very short notice that they’ll have to look for a plan B.

‘It’s a huge loss to my already overdue post-lockdown business of almost £3,000, plus the time already spent planning with the client.

“I renewed my passport in September when it expired. At first they said it might be lost and I went back and forth trying to find out where it was.

“I only received a message three days ago that he had arrived. This will have a huge impact on me trying to revive my business after the pandemic.

Another holiday hopeful also told MailOnline how he now stands to lose £1,800 due to delays in receiving his passport.

Kym Wylnp said she plans to take her daughter and four-year-old son to Spain next month.

The 62-year-old local worker delayed her daughter’s passport and without the document she cannot order a passport for her son.

“She needs the passport to order her son’s passport because she needs ID. We ordered them in January, so we thought they would be there at least in April. It was an absolute nightmare.

“We taught him (my grandson) little bits of Spanish and I paid for swimming lessons because there is a water park.

“He’s only four, so he’s had half his life disrupted by Covid, and this is the last chance to go on holiday outside of school terms. It would be a shame if he couldn’t go.

The Employees Retirement Income Security Act of 1974 (“ERISA”) seeks to balance the twin politics of (1) ensuring fair and prompt enforcement of entitlements under employee benefit plans and (2 ) encourage the creation of such schemes. To strike this balance, ERISA combines comprehensive fiduciary liability rules with federal causes of action that allow plan members and beneficiaries to recover benefits owed, enforce ERISA mandates, obtain an injunction and, where appropriate, to obtain attorneys’ fees. At the same time, to protect employers and plan sponsors from operating under a patchwork of potentially conflicting state and local regulations, ERISA promotes uniformity in benefits administration by preempting “all state laws as they may now or hereafter relate to any ERISA. benefits plan. 29 USC § 1144(a).

The Supreme Court is currently considering a petition for certiorari that deals with the application of the ERISA preemption to local “play or pay” laws. Apparently, these location-specific laws are intended to improve low-wage employees’ access to affordable health coverage by requiring large employers to increase health care spending on behalf of those employees who reside in that location. To evade ERISA preemption, these laws typically provide that instead of modifying their existing ERISA plans to reflect enhanced benefits, employers can simply send a check for the same amount directly to their employees or, in some cases, to the government. local.

Seattle passed such a law in September 2019. Seattle SMC Order 14.28 (“Ordinance”) directs large hospitality employers operating in the city to make monthly health care payments on behalf of their covered local employees. Payments increase depending on whether the employee is single or has a spouse and/or dependents. Employers who fail to comply with the Ordinance are subject to fines, penalties and other damages. Employers can comply by creating new ERISA plans specifically for covered employees, increasing their employees’ contributions to existing ERISA plans, or making payments directly to covered employees.

The ERISA Industry Committee, a nonprofit trade association, filed a lawsuit alleging that ERISA preempted the order because it “relates” to an ERISA benefit plan. The district court granted the city’s motion to dismiss, finding that ERISA does not override the order because it provides employers with a compliance option (i.e. direct cash payments to employees ) that does not require the creation of a new ERISA plan or the modification of an existing ERISA plan. . ERISA Industry Committee v. City of Seattle, 2020 US Dist. LEXIS 81750 (WD Wash. May 8, 2020). In an unpublished opinion, the Ninth Circuit asserted. 840 F. Appx. 248 (2021).

The Committee sought certiorari from the U.S. Supreme Court, arguing that the Ninth Circuit’s decision deepened an existing split with other appellate courts, which have ruled that even a direct-pay option interferes with the ERISA plan administration because it requires employers to constantly monitor state and local minimum expense requirements and adjust their healthcare expenses.

Big employers have a vested interest in seeing the Supreme Court grant certiorari and overturn the Ninth Circuit’s decision. While local gambling or compensation laws may serve the salutary goal of ensuring good benefits for local employees, large employers argue that such a goal cannot outweigh the overriding federal concern that National employers can design benefits that work for their national workforce. ERISA already imposes significant obligations on plan sponsors and trustees to administer benefits, and it is important that these employers are able to administer their plans consistently in accordance with ERISA.

The direct payment option does not make gambling or payment laws such as the Ordinance less intrusive on ERISA’s domain. As the Committee argued in the proceedings before the District and Appellate Courts, out-of-pocket payments are “financially more onerous and therefore not a realistic and legitimate alternative” to modifying an employer’s current coverage. to address covered employees. This effectively requires employers to modify their current coverage to meet the requirements of any local gambling or payment laws that may be in effect in each jurisdiction in which they operate. Such tiptoeing through the administrative raindrops of multiple (and potentially conflicting) local regulations — and the added costs and complications associated with such maneuvers — is precisely what ERISA preemption aims to eliminate.

KUALA LUMPUR (May 11): Businessman Datuk Habibul Rahman Kadir Shah has filed a motion to strike a counterclaim by Syed Saddiq Syed Abdul Rahman, claiming the counterclaim was an abuse of legal process.

Previously, Syed Saddiq filed a counterclaim stating that Habibul’s defamation suit against him was without merit and also constituted an abuse of process.

Habibul is suing MP Muar for remarks the latter made during a press conference at the Seri Pacific Hotel in Kuala Lumpur on October 2, 2017, when he was part of the Pribumi Bersatu Malaysia Party.

At the press conference, Syed Saddiq said there was a plot by anonymous party leaders to weaken the party by “threatening or bribing” its leaders.

Reports had indicated that Syed Saddiq, who was then Bersatu’s youth leader, had also alleged that there had been a “systematic” attempt to influence Bersatu leaders to leave the party.

Habibul is suing Syed Saddiq because he believed the latter referred to him as one of the party leaders who threatened and bribed.

Habibul is a former adviser to ex-Prime Minister Datuk Seri Najib Razak.

Previously, Syed Saddiq, in his defense against the lawsuit, cited the defense of justification, qualified privilege and fair comment.

In Habibul’s request that was spotted by peak markets, Syed Saddiq allegedly uttered those words maliciously to tarnish and hurt the former’s reputation in public.

Habibul also said that Syed Saddiq had no right to use the argument of qualified immunity in this case because the latter’s statements were “baseless” and “without public importance”.

“The words spoken in 2017 were for his own (Syed Saddiq) political gain,” the app reads.

Habibul also said that Syed Saddiq cannot stick to the fair comment argument because his comments were not based on facts and were only meant to “satisfy his anger, displeasure and malice towards him. (Habibul)”.

“Plaintiff (Habibul) declares that Respondent’s comments were not told in truth or with good intentions or with verification of facts,” reads the request.

“Furthermore, the plaintiff argues that the defendant’s counterclaim may impair, impede or delay the fair conduct of the action (the defamation action),” Habibul argued.

According to Syed Saddiq’s lawyer, Lim Wei Jiet, the counterclaim has been filed in court and the handling of the case has been set for July 21.

The motion to strike the counterclaim was filed by the law firm Jahaberdeen and Co.

City preservation officials have said no to developer Douglas Jemal’s plan for a porte-cochere entrance to the Richardson Hotel & Conference Center.

But that doesn’t mean the proposal is dead.

In a surprise decision that caught the developer slightly off guard, the Buffalo Preservation Board denied Douglas Development Corp.’s application. carriage porch entrance to the north entrance of the Richardson Hotel & Conference Center.

But the rejection was done in a way that allows Jemal to come back later with a revised proposal.

The panel’s vote on Thursday night — instead of continuing to file the contentious request, as Jemal wanted — was at least partially administrative in nature and doesn’t necessarily kill the project, which was in limbo even before the vote. The current underpass proposal at the Old Henry Hotel has come under heavy criticism from the preservation community, but both parties are working to address these concerns.

On the contrary, council members felt that some sort of decision was necessary to comply with the deadlines that the Preservation Council must meet with applications. And they cited the uncertainty of ongoing negotiations between Jemal and the Preservation Board, State Historic Preservation Office and National Park Service – all of which must approve any project involving the historic Richardson-Olmsted campus and a 50-year preservation pledge. years.

“We didn’t know how long the process would take,” said Preservation Council President Gwen Howard. “So we’ve chosen to take it off the table and deny it without prejudice, so that there can be time in the process for all agencies to understand the project, review the project and give their approval.”

But it sent a clear message that council members were unhappy with the proposed size, scale and design of the covered entrance which would extend 86 feet from the building’s frontage and would rise 30 feet above the driveway. The board also said the plan created “a visual obstruction of the twin towers of the Richardson Olmsted complex” and violated federal preservation guidelines.

The panel was also hindered by the presence of a platform deck above it, surrounded by a glass railing, which creates a balcony that can be occupied.

“It was definitely a denial on the merits,” Howard said, calling it “too big, too tall, and not sympathetic” to the building’s original design.

She also said there were “inconsistencies” between the drawings and renderings submitted to the city, and even with the reality of what was already built.

“The file they submitted to us were two different things,” she said. “The drawings and the renders and what they built didn’t match each other.”

However, according to the committee’s decision, “another canopy of appropriate scale, height and materiality may well be approved under these standards and guidelines.”

Paul Millstein, executive vice president of Douglas Development and deputy chief of Jemal, said the message was received.

“It was more of a procedural thing, but I think they also wanted to make their feelings known, which they did,” he said. “By denying it, instead of filing it, it gave them a clear opportunity to let us know what their objections were and gave us a chance to refine our presentation and thoughts so that we could come back and hopefully , find common ground in the near future.”

Local officials filed the request two weeks ago, hoping to coordinate their discussions and concerns with their state and federal colleagues. “We weren’t able in this two-week period to organize this coordinated conversation,” Howard said.

“Because we don’t know the timelines, we wanted to protect the process, so it didn’t expire,” Howard added. “It was clear that what had been submitted was not going to be approved anyway.”

Six steel columns and the structure’s roof framework have already been erected at the historic site – due to poor communication and misunderstandings within the city. But further work was halted until Jemal’s team could resolve disputes with municipal, state and federal officials so the project could be officially approved. Otherwise, the city can order Jemal to remove what has already been installed.

However, Millstein insisted the company remains confident in its design and plan and intends to continue with it. Representatives from Douglas Development will meet with representatives from Howard and SHPO on Monday morning.

“We think that’s the right doorway for this project. We have a lot of experts supporting this theory, and we haven’t explained the reasons well enough, and that’s up to us,” Millstein said. “We expect to do a better job on Monday, so the rest of the groups will see the light.”

Millstein suggested that state and federal officials would have a different opinion if they came to campus to see what the structure actually looks like, not seen in a photo or rendered from an office in Albany or Washington. .

“My reaction was dramatically different once I walked around and experienced it in person, and in the context of the entire Richardson campus,” he said. . “It doesn’t obstruct the glass curtain wall that’s there at all. It gives it a sense of place. It provides an opportunity for activation. It takes the back of the building and gives it a prominent entrance.”

And, he noted, it doesn’t change the physical structure of the building, because “it’s bolted, bolted” and can be easily removed.

“We see no reason why we wouldn’t be able to continue as presented, with some improvements that we would consider minor,” he said. “The Preservation Council has been very respectful. They have been communicative. We look forward to continuing to work with them on this project and many more in the future.”

A REQUEST for year-round use at Waterside Holiday Park at Bowleaze Coveway in Weymouth will be decided by Dorset Councillors.

More than 40 people opposed the request which will be heard at a meeting of the planning committee on Thursday, May 5.

Officers recommend accepting the proposal saying there will likely be no “significant damage” to the area due to the extra weeks.

Those opposed cite increased traffic problems, with the site becoming full-time residential by default, turning the area into “a substandard housing estate” and year-round disruption.

Some objectors say the 46 weeks currently allowed for most of the site should be enough for financial stability and worry about the increased impact on the heritage coast: “It’s not sustainable tourism and goes to the against environmental objectives,” said one.

Other concerns raised were the impact on the traditional hotel and B7Bs in the area, the increased burning of fossil fuels for heating and lighting and the assertion that nature needs rest for at least a part of the year.

Certain sections of the site are subject to historic conditions which limit their use while a few areas may already be open throughout the year.

The site adjoins the Dorset Area of Outstanding Beauty and the Heritage Coast.

Over the years many of the caravans on the site have been replaced by wooden lodges which operators say make them more suitable for year-round use, coupled with the demand for “staycation” holidays throughout the year. Other sites in the region are already in use all year round.

Wessex Water says it has no objections, but says any changes to increase pipe sizes or flow rates should be agreed in advance and should first be prioritized on the need to maintain all existing household services.

The council’s Economic Growth and Regeneration team said general improvements in accommodation standards, temporary reductions in opportunities to go abroad and more flexible working patterns that make weekends easier have all helped to increase demand for what was previously considered the closed holiday season.

He adds that increased usage could bring other benefits to the local economy: “From a tourism and economic development perspective, increasing demand for mid- and off-season tourism has long been a strategic objective, as it increases tourism revenues, encourages the substitution of seasonal jobs with year-round jobs, and does not put the strain on infrastructure and the congestion that peak season demand can bring. Increased demand could justify improving year-round bus services on local routes, also improving sustainable transportation for residents and workers.

Site owners and supporters of year-round use say the extension will create jobs and bring financial benefit to the region.

The report of a person in charge of the planning file concludes: “The extension of the period of occupation of holidays from 10 months to the full 12 months of the year would allow greater flexibility and/or the possibility of taking holidays in outside of the main season. It would also mean that the whole site would have the same level of occupancy allowed everywhere. It is a sustainable development because it already exists in this place. From an economic perspective, this could translate into economic benefits for local facilities during the otherwise quieter winter months. From an environmental point of view, the units are already installed on the site all year round.
