Financial website Wallet Hub recently published a study naming Montana the sixth worst place in the United States to be a law enforcement officer.

KGVO reached out to Wallet Hub analyst and attorney Jill Gonzalez to find out why Montana ranked so low on the list nationally.

“(Montana) is not the best place for a cop,” Gonzalez began. “Montana currently ranks 45th out of 50 states and DC, so it’s in the bottom 10, especially when it comes to occupational hazards. It’s not necessarily such a crime-ridden state, but just when we’re looking at such a large area to cover for road safety. It’s a concern there because there are simply so many roads to travel. So that’s what we’re looking for here in terms of agent safety. »

Gonzalez went deeper into the study of Wallet Hubs and why Montana has failed to enforce the law.

“We look at about 30 different indicators of police friendliness that range from the median income of law enforcement officers to things like police deaths to national and local police protection per capita,” a- she declared. “So not just from a cost perspective, what does the opportunity look like and are there any jobs available? What are the training requirements? What are occupational hazards and protection? »

Gonzalez provided suggestions for improvement from the Wallet Hub study.

“When we look at training requirements and things like body cameras and so on, that’s one area where Montana could definitely catch up with most other states,” she said. “There isn’t necessarily any police body camera legislation yet, like in many states. Do you have that now? Even things like carrying naloxone to help prevent overdose deaths. That’s something that could be a little better in Montana too.

Gonzalez had more suggestions for improvement to help Montana move up the list by becoming a more “police” state.

“I think I see what kind of legislation is in place,” she said. “Obviously the police don’t make legislation, but it’s something that you really have to look at having the power to make sure that we see that the police in Montana are getting as good training as the police of New York. , that technology is catching up, and that the police themselves are catching up as well.

Connecticut, California and Illinois were named the three “best states to be a cop”, while Alaska, Hawaii and Arkansas were last on the list.

The inn is run by Executive Chef Patrick O’Connell, a self-taught cook from Washington DC known as “the pope of American cuisine”. He opened the venue in 1978 and has hosted celebrities, politicians and more, according to the website.

O’Connell in 2019, won the Lifetime Achievement Award from the James Beard Foundation and the National Humanities Medal from the President of the United States in the same year, his restaurant’s website says.

Eat This, Not That describes The Inn as a “fancy” hotel and restaurant that has been awarded three Michelin stars and Green Star sustainability. The products you will see on the menu are grown on the website’s own farm.

About National Police Week

In the hospitality industry, one of the big challenges is generating direct online bookings. For those of you unfamiliar with the concept of direct online booking, it specifically means a reservation made through the hotel’s website. Nowadays, hotels not only compete with neighboring hotels, but also with OTAs (online travel agencies). Examples of some of the well-known OTAs are booking.com, Expedia. com and hotels.com. These sites list and rank all hotels and then provide links to book them. The reason why OTAs are a significant source of competition for the hotel has to do with the massive size of their marketing budget, the concept of parity and profit. By agreement, hotels must provide their exact BAR (best available rate) to OTAs. This means that OTAs and hotels will show similar low prices, hence the parity. The issue is how much money the hotel makes from booking direct on their site versus booking on an OTA. On a direct booking, the hotel retains 100% of the revenue. With an OTA booking, the hotel keeps between 75-90% of the revenue through the commission agreement it has with the OTA. Hotels that lack awareness desperately need OTAs to drive bookings.

This is where the challenge lies. In these types of situations, the goal is to try to funnel the transfer from the OTA to the hotel’s website. The typical pattern of the customer journey booking a hotel in an unfamiliar location is to first visit an OTA to narrow down their list of hotels based on location, price, and reviews. Then, the customer typically goes to the hotel’s site, learns more about the hotel, and views relevant content. In the last step, the customer usually returns to the OTA to book. One of the goals of the hotel website is to drive the customer to search and entice them to book on the hotel website rather than returning them to their previous OTA channel.

In addition to trying to change shares, hotels are leveraging SEO, SEM, banner campaigns, as well as meta-targeting to attract and increase awareness in an effort to entice potential guests to visit their site. website. Once on their website, hotels have the option to convert the viewer (customer) into a reservation. This conversion attempt can be augmented and facilitated by third-party solutions that hotels often place on their website. These solutions include custom post formats with optimized display timing, a robust set of dynamic targeting options with custom content, widgets that pull price comparisons from OTAs, widgets that pull customer reviews and reviews to be posted on the hotel’s website. The challenge is to determine the value of this conversion and show the ROI from the annual/monthly cost of this service. To do this, the hotel needs to determine how much additional traffic the solution helps convert beyond what the hotel page would be able to do on its own.

Companies similar to The Hotels Network that provide this specific type of technology are creating ways to measure and attribute value to their messaging and revenue. These tools typically generate a 10-20% return on investment. They do this in several ways. They track bookings per clicks as well as revenue associated with an influential conversion message that the viewer was exposed to during their booking journey. This type of attribution is similar to companies that run banner campaigns associated with post-view attribution.

The best way to measure the conversion of these campaigns on your site is to perform A/B testing. A/B systems test a message that is automatically split between the (exposed) campaign and a control group. The next step is to wait until you get a statistically valid measurement to increase the level of confidence in the results. For hotel websites that have high traffic, results come quickly with an industry standard minimum benchmark of around 10,000 impressions. However, with lower impression rates, the expected margin of error should be increased or hotels should continue to run the test until the expected threshold is reached. If there is strong direction in the results before reaching the threshold, the test can stop and the results can then be added to the hotel team’s overall marketing learning.

Different types of messages can be tested regarding urgency (low inventory), limited time offers, exit messages, and nudges. Regardless of what is placed on the site, it should be tracked and conversion should be assessed. For these types of messages, the system must, at a high level, track visitors, bookings, revenue, and the specific campaign group. Beyond that, to get to more granular levels, there needs to be an assessment of device type and even country (at least these days) to see how that information relates to the booking.

All in all, when it comes to hotel websites and conversion, hotels need to lean in and embrace the tools at their disposal. In addition to the myriad of channels that can be leveraged to drive traffic to the website, hotels must now use technology to convert the traffic they have. The cost of not doing so means the potential loss of bookings. Not just to a competitor, but perhaps to a lower profit source of an OTA.

Virtually every business establishment these days knows that they need to have a web presence to be a commercially viable business. But what many business owners don’t realize is that their websites can put them at significant legal risk, including becoming the target of accessibility lawsuits.

Title III of the Americans with Disabilities Act (ADA) prohibits discrimination against people with disabilities by businesses open to the public.(1) Poorly designed websites can create accessibility barriers for the visually impaired and other people with disabilities, thereby preventing their full and equal enjoyment of the organization’s goods and/or services. The number of websites targeted by website accessibility claims continues to rise, with no indication that they will slow down in the near future. According to UsableNet, more than 4,000 such lawsuits were filed in state and federal courts in 2021, with more than 10 lawsuits filed every day. (2) The vast majority of claims are filed in California, New York and Florida. E-commerce sites account for nearly 74% of these disputes(3). Most of these disputes are brought by a small number of plaintiff law firms representing visually impaired consumers.

On March 18, 2022, the U.S. Department of Justice (“DOJ”) for the first time provided guidance on how companies can make their websites publicly available under the ADA, but did not adopted a regulatory standard for what constitutes “accessible”. (4) (DOJ guidance on website accessibility can be found here.) The DOJ leaves it up to state and local governments to determine whether a website is ADA-compliant. Due to the lack of detailed formal standards regarding ADA website compliance and limited case law on the issue, a cottage industry has emerged, often with results favorable to complainants. Notably, multiple website accessibility lawsuits can be brought against a single company. The fact that an accessibility complaint has already been filed against a business does not preclude plaintiff law firms from pursuing additional accessibility lawsuits against the same business. Indeed, nearly 500 of the 4,000 lawsuits (or 15%) filed in 2021 were against companies that had previously been the subject of complaints about website accessibility.(5) Complaining companies are also starting to target apps mobiles with ADA accessibility claims.

The legal regimes currently in place and the lack of applicable case law (given that the vast majority of these cases are settled) allow plaintiffs’ companies to continue to bring these types of claims, regardless of their merits, in part thanks to the legal incentives created by the possibility of recovering the fees of their lawyers. In California, cases are generally brought under the California Unruh Civil Rights Act (“Unruh Act”),(6) which is broader than the federal ADA. The Unruh Act aims to deter discrimination by “all commercial establishments of any kind”, while ADA Title III aims to prevent discrimination in a “place of public accommodation”. A finding of a violation of Title III of the ADA results in an award of injunctive relief and attorneys’ fees, but not compensatory damages to remedy the violation. In contrast, under the Unruh Law, the plaintiff is entitled to recover actual damages and an amount of up to three times the actual damages for each violation, or alternatively, statutory minimum damages of 4,000, $00 per violation plus attorney’s fees.(7) A violation of the ADA is also a violation of Unruh.(8)

Website accessibility complaints are typically preceded by a formal notice to the website owner, followed by a settlement proposal that includes the company’s agreement to improve website accessibility and payment of the plaintiff’s attorney’s fees and expenses.

Quick tips

As we become increasingly dependent on access to services via the Internet, it is important that companies implement policies to ensure that their websites are accessible to people with disabilities. Below are five quick tips for accomplishing this task while helping to protect your business from a website accessibility claim:

1. Audit your website to ensure that it meets current industry standards as set out in the Web Content Accessibility Guidelines (“WCAG”) 2.1 or later as published by the Web Accessibility Initiative of the World Wide Web Consortium. Any audit should include a manual, in-person audit of your website to identify potential barriers to access. For example, visually impaired users use screen reader software to browse the Internet (eg, NVDA, JAWS, and VoiceOver). Make sure the audit you perform includes testing of the website using screen reading software by a visually impaired user.

2. Address and correct any accessibility issues revealed by the audit, especially those in high traffic areas of the website (e.g. homepage, registration, shopping interface and key content pages). These fixes should include, but certainly not be limited to, issues regarding poor color contrast, alt text for images, and captions for videos. Try to keep website layouts consistent.

3. Adopt and maintain a policy to ensure that your website remains accessible as updates are made to the website over time. This includes periodic website audits, testing by people with disabilities, and accessibility training for web page and content developers.

4. Add an accessibility statement to your website with a trusted method for users to contact you (e.g. phone number or email address on your homepage) if they encounter accessibility issues on the site.

5. Avoid automated software solutions that claim to be able to keep your website accessible without any human testing or monitoring. These are band-aid solutions that often fail to ensure actual WCAG and ADA compliance. Nothing replaces manual testing.

If your business is located outside of California, consider adding a “clickwrap” agreement to your website that requires a user to acknowledge or agree (i.e. an “I accept” checkbox) website terms of use before accessing the website. Include a provision in your Terms of Use policy that requires all claims or disputes to be brought in your local state or federal court. For example, if your business is located in Nevada, require users, as a condition of using your site, to submit to the exclusive personal jurisdiction of a court in the State of Nevada for any disputes related to the site. website.

Choice Hotels is not making its website accessible to the blind, further heightening the stigma of people with visual impairments, according to a new class action lawsuit.

Plaintiff John Mahoney filed the class action lawsuit against Choice Hotels International, LLC on April 18 in federal court in Pennsylvania, alleging violations of the Americans with Disabilities Act (ADA).

Mahoney, who is legally blind, said he needed screen-reading software to read content from the website using his computer.

He alleges that Choice Hotels refused service to people who are blind or visually impaired because it did not make its website available in a manner compatible with computer screen reading programs.

“Choice Hotels…deprives blind and visually impaired people of the benefits of its goods, services, facilities, privileges, benefits or accommodations from its public accommodations – all of the benefits it provides to people without disabilities – thereby increasing the sense of isolation and stigmatization among these people. Americans that Title III was meant to fix,” the class action lawsuit states.

Mahoney said choicehotels.com has never been accessible to blind people because the hotel never had an adequate corporate policy for its website to become and remain accessible.

Choice Hotels Needs Consultant to Make Website Accessible, Class Action States

Mahoney asks Choice Hotels to retain the services of a qualified consultant to ensure that the website is made accessible and remains so in the future.

He alleges that the Choice Hotels website lacks alt text, which allows people to “see” images on a web page.

“Plaintiff was unable to differentiate the products displayed on the screen due to the website’s inability to properly describe its content,” the Choice Hotels class action lawsuit states.

The website also contains numerous broken links, which cripple screen readers, according to the lawsuit.

Mahoney seeks to represent anyone nationwide who attempted to access the Choice Hotels website with a screen reader and was unable to access company goods and services.

He is seeking a declaratory judgment that the hotel chain broke the law, a permanent injunction compelling him to make the website ADA compliant, costs, fees and class action certification.

Meanwhile, Choice Hotels is a defendant in a sex trafficking trial in which a woman named anonymously as Jane Doe 1 alleges that the hotels knowingly allowed sex trafficking take place on their property.

The soon-to-open ON Residence website in Thessaloniki is up and running, allowing travelers to experience the hotel’s luxurious offerings even before their stay begins.

ON Residence is a new boutique hotel located on Nikis Avenue in Thessaloniki’s central waterfront, set to open on April 29.

Designed by Eyewide Digital Marketing Agency in cooperation with Point Blank, the new personalized and responsive website – www.onresidence.gr – of the ON residence allows users to fully familiarize themselves with the unique philosophy of the hotel; browse the suites and rooms; and “enter” the legendary Olympus Naoussa restaurant and the elegant Tiger Loop Bar.

Improved features help inform users about luxurious hotel facilities, as well as organize a trip to the Greek city of Thessaloniki.
